USING LABOR CENTRALIZED MANAGEMENT SYSTEM BY ONLINE

SYSTEM

Minister of Ministry of Labor and Vocational Training

- Having seen the Constitution of kingdom of Cambodia;
- Having seen the Royal Decree NS/RKT/0913/903 dated 24th September, 2013 on Nomination the Government of Kingdom of Cambodia;
- Having seen The Royal Decree NS/RKT/1213/1393 dated 21 December, 2013 on Changing and additional the composition of Government of Kingdom of Cambodia;
- Having seen the Royal Decree NS/RKT/0416/368 dated 04 April, 2016 on Changing and Additional the composition of The Government of Kingdom of Cambodia;
- Having Seen The Royal Kram 02/NS/94 dated 20 July, 1994 Promulgated on the Law of Organization and Functioning of The Council Ministers;
- Having Seen The Royal Kram NS/RKM/0105/003 dated 17 January,2005 on Promulgation law of creation of Ministry of Labor Law and Vocational Training;
- Having Seen The Royal Kram CHS/RKM/0397/01 dated 13 March, 1997 on Promulgation of Labor Law;
- Having Seen Sub-Decree No. 283 OrNKr.BK dated 14 November, 2014 on Organizing and Functioning of Ministry of Labor Law and Vocational Training;
- Having Seen Joint Prakas No. 1009 SHV-BrK dated 28 December , 2012 on providing Public Service of the Ministry of Labor and Vocational training;
- Having Seen Prakas No. 195 KB.BrK dated 20 August, 2014 On Work Permit and Employment Card For Foreigner of The Ministry of Labor and Vocational Training;
- According to letter No. 133 SCHN.OrV dated 01 February, 2016 On The Council of Minister;
- According to the Necessity of the Ministry of Labor and Vocational Training;

Hereby Decides

Article 1._

Shall be processed the Foreign Labor Centralized Management System in order to manage the employment of foreign Labor in Cambodia by the online system through home page www.fwcms.mvlt.gov.kh from 01 September, 2016.

Article 2._

Investor, company, factory, enterprise/establishment which employ the foreign workers shall be completed the form of quota request for foreign labor by new online registration from September 01st, 2016 onward.

Foreigner that enters to works in Kingdom of Cambodia shall complete the request form of “Work Permit and Employment Card” through the centralized management system form September 01st, 2016 onward.

In the necessity case, the Department of Occupation and Employment or Municipal Department of Labor and Vocational Training of the Ministry of Labor and Vocational Training can propose to the proposer the show up or give the necessary document.

Article 3._

Allow to Company E-Solutions (Cambodia) Co., Ltd to get the profit of:

- 30 (thirty) dollar per proposal on additional of public service fee to request the quota for employment foreign labor that shall be paid into the bank system.

- 30 (thirty) dollar per foreign employment on additional of public service fee for request the new work permit/employment card or extend a work permit/employment card shall be paid into the bank system.

The additional paid profit to E-Solution (Cambodia) Co., Ltd for:

1. Preparation data system to manage the new workforce, build the structure, set the training equipment to commence the one window office.

2. Supporting the input data and managing data of Cambodian employment whom works in company, factory, enterprise and establishment in Kingdom of Cambodia (exclude the additional paid) in order to ensure the seniority of Cambodian employment.

3. Supporting the process of the data management of Labor Inspector and supply portable electronic equipment to labor inspector during the inspection focus on the improvement of the efficiency, quality and the possibility of monitoring of the background of working conditions of the each company, factory, enterprise and establishment.

4. Produce the working permit/employment card for foreigner and the service of sending the working permit/employment card give to titular.

5. Constructing a new one window building which has three floors equal to 828 (eighty three hundred and eight) meters.

Article 4._

For fulfilling a new request form of work permit/new employment card of foreigner or extend the work permit/employment card of foreigner, foreigner can use the own Health Checkup Certification which is still on valid, but shall request to certify from the Department of Occupational Health and Safety and pay the public service fee for 20.000 (twenty thousand) riels to the Department of Occupational Health and Safety of Ministry of Labor and Vocational Training through the online system first.

Article 5._

Any provision contrary of this Prakas shall be abrogated.

Article 6._

Chief of Cabinet, General of the General Director of Administration and Finance, General of the General Director of Labor, President Department of Occupation and Employment, President Department of Medical Labor, President of Municipal Department of Labor and Vocational Training shall implement this Prakas on duty after the date of signature onward.
